If someone noticed, the php-nuke are gnu/gpl script.
Theme designed for php-nuke have to obey gnu/gpl rules of distribution.
So it simply means that anyone allowed to distribute theme for free.
Hm. Sounds strange, but logical.

So, you see, if you make something to include or work only with gnu/gpl product you must release you product on gnu/gpl terms, with all the restrictions.
is that is the case then any software that runs on linux should be free as well :P

Bad move. We think each one have to be responsible for his own actions, without references to "hey guys, look, some creators of software on linux do the same, so I don't care about is it right or wrong, I'll just do the same".

One of reason because php change license type from GPL to LGPL is easy... GPL didn't allow normal commercial trade of scripts. Because of GPL restrictions. So php license changed to lgpl.

The one who care about it should think and spend a 30 minutes to read gnu/gpl license before spending hours in hard work :-)
ALso, do you think php-nuke were created in few minutes and there were no hard work and creators didn't spend hours to make php-nuke?
This is nature of FREEDOM and OPEN-SOURCE which gives gnu/gpl. :-P
P.S.: BTW, if you are really interesting in this topic - we offer you to open topic in forum. Comments is bad place for it:-) We can say much more on this topic, basically we feel you misunderstand our words a bit.

We never said that gnu/gpl decline to trade the scripts.
We just say that making work based on gnu/gpl scripts, or destined to work with gnu/gpl scripts, or be part of this is not the same as releasing commercial product. It have restrictions, and all restrictions are described in gnu/gpl. |

Peoples just looking that it's free and think that they can do anything with it because they got it for free, they also looking how other peoples acts with gpl products and do the same... So one mistake born another mistake and it's continious.
About commercial products based on phpnuke. We mean modules, yes? Here is several parts of story.
1) Probably creators of software don't know about gnu/gpl too. It's possible.
2) GNU/GPL license DOESN"T mean that you MUST give peoples gnu/gpl product for free. It's just mean that ANYONE ALLOWED to distribute gnu/gpl for free.
Feel the difference? Most clear example. phpnuke.org charging 10$ for latest version of php-nuke... but in same time you can download it for free from many other sites, and it's legal.
3) So called "standalone" products. Let's guess that someone created module which works with "fantasy cms" which is based on commercial license. Let's make a second guess that this module are compatible with php-nuke W/O CHANGES. In this case... if you will unite this module with php-nuke and will distribute in one package - you will have to put gnu/gpl license on your module. BUT! If your module CAN work without php-nuke AND you distribute module separately from phpnuke- you can put your own commercial license on this.
Most of commercial product works by 2nd point. Yes, it's risky enough that someone will put it for free download, but... phpnuke.org have enough members who pay for latest version of phpnuke though they can download it for free on other sites. It's some kind of donation, but a bit more tricky:-) If someone paid for module, such person rarely will want to distribute it for free.... especially if he don't know that he have right for it (as we told... it's very common mistake about gnu/gpl products).
Some of commercial products works by 3rd point. Most of them were natural born standalone scripts, and can work w/o phpnuke.
And the last one thing to add. Rules only deals with developer, distributor of code, programmer and etc. Final user can use any mix of scripts... commercial and gpl and so on... for his own site.
Now a bit about "themes" for php-nuke. We are not sure if it can be handled by 3rd point, but if there are any NOT gnu/gpl CMS there you themes can work w/o changes, you can just announce it like work for such CMS and announce it compatible with phpnuke. Also, you can act by 2nd point, if you don't have any commercial and copyrighted graphics included.
So you see. gnu/gpl doesn't mean that you can't get money for work. It just mean that you can handle it same way like with commercial license.
Basically, we would recomend you to read gnu/gpl license and especially FAQ for it very carefully. We sometimes reread it from time to time to fresh it in our memory:-) Main thing... it was not created for making money, it was created for make all software free and open source... |

Copyrights. Copyright removal are not allowed by gnu/gpl.
Basically, you can release theme product based on gnu/gpl basis... but... allow PEOPLES (by his own hands) to remove your copyrights if they paid for this ability/
It's borderline solution but we believe it have to be legal. In this case you don't distribute theme w/o copyrights. You just sale right to remove your copyright. And we believe theme w/o copyrights looks much more good:-) |

Themes do not share data structures they are a conduit.
Also I would read "they make function calls to each other" as something that goes back and forth from the plugin back to the core program. Which doesnt happen.
Though I can see arguements for this being the case too.
PHPBB has many threads about this. The answer there seems to be that if you do not use the tpls with subsilver or any other template you are allowed to sell the theme but its still covered under GPL. |

You can do a theme with out using banner.php file, is_user, & public_message. I guess you would still need blocks, though I think personally that is a stupid way to manage that. |

But the fact is that you can't make the theme w/o two-ways call of functions and sharing data.
But, here is the other way. It's possible to create "regular" theme, or take any theme on HTML-templates. In this case theme itself have to be distributed on gnu/gpl basis... but html templates and graphics will be done the same way like in phpbb - more than enough standalone.
Hm. We think this was is just the best. It's 100% compatible with gpl license and allow trade design w/o restrictions.
